  1. Patient rights regarding the medical file are regulated in both specific and general legislation: specific rules can be found in the Health Act and the Professional Ethics Code and general rules on the medical file can be found in the Personal Data Protection Act.
  2. The treating physician has an obligation to keep a medical file of the patient and he is responsible for its storage. If he stops his/her participation in the treatment, he is obliged to ensure continuity in the treatment by presenting all the necessary information to the physician who will replace him/her. In the Health Act a patient right regarding the medical file is not included in the Section “Patient’s Rights and Obligations”. The articles related to the medical file can be found in the first Chapter of the Health Act, under Section V “Health Information and Documentation”.
  3. The term “health information” means the following: “the personal data related to the health condition, the physical and mental development of individuals, as well as any other information contained in medical prescriptions, instructions, protocols, certificates and other medical documentation.”
