- The patient shall have the right to complete medical information. This includes “the diagnosis of the patient’s medical condition and, if possible, its prognosis”. The information shall be given to the patient or the person he has chosen to be informed on his/her behalf, in a comprehensible manner, refraining from using as far as possible technical terminology.
- The patient is not considered to have disclaimed the right to information, unless he has requested so in writing. The right not to know can be deduced from this article.
- The physician is entitled to withhold information from the patient, but only in exceptional cases, when there is a valid reason to believe that this information may cause serious harm to the patient’s mental or physical health.
The therapeutic exception can only be used in the patient’s health best interest.
