General National Patient Rights Protection

Some provisions related to patient rights are laid down in the Basic Law on Health 48/90 of 24 August 1990. However, these norms are too vague and general to be of practical use. There are no specific regulations to guide the health provider on the detailed contents of the declared rights of a patient.

Since then, patient rights have been reinforced through several acts, such as the Mental Health Act n° 36/98 of 1998 as well as the Law N°45/2003 of 22 August 2003 on the non-conventional therapies. Moreover, the Law n° 12/2005 of 26 January 2005 on personal genetic information and health information, the Law n° 32/2006 of 26 July 2006 on medically assisted procreation, the Law (decreto-lei) n° 60/2003 of 1 April 2003 on primary health care and the Law (decreto-lei) n° 281/2003 of 8 November 2003 on continuous health care contain several dispositions on patient rights.
