1. One of the major patient rights, which are dealt with by the new law extensively and in detail, is the right to appeal and the right to proceedings in cases of violation of the patient's rights. The act lays down a two-stage (extra-judiciary) procedure and also introduces the important post of the patient's rights representative. The act also tasks the Human Rights Ombudsman with monitoring the implementation of the act and to the issuing warnings to responsible bodies to make sure that the conditions for carrying out the act are met.
2. In the Republic of Slovenia liability for damages is governed by the general provisions of civil law - that is with the provisions of the Code of Obligations. The following criteria must be cumulatively met for liability for damages to exist: a) Unlawful damaging act, event or behaviour; b) Inadmissible damages; c) Causal association (causality) between unlawful activities and inadmissible damages; d) The existence of liability of the perpetrator of the damages.
