1. The Act on Patients Rights makes reference to the right to be informed and does not differentiate between the right to informed consent and the right of a patient to information about his health.
2. The right not to know about one’s health condition is set down in the Act on Patients Rights, which states that the doctor must respect the patient’s wish that he does not wish to be provided with information on his health state. An exception to this is when not informing the patient of his health state could pose a serious health risk to other persons.
3. Slovenian legislation regulates the therapeutic exception in the Act on Patients Rights. This Act determines that the doctor may in exceptional cases withhold information from the patient if he deems that, in the given circumstances, disclosure could have serious harm for the patient’s health. This does not apply if a patient with full disposing capacity expressly demands that he wants to be informed in full of his state of health. Doctors must document the reason for withholding information from a patient in the medical file.
