1. Slovenian legislation does not expressly deal with the right to a medical file, although this right is indirectly provided for in several regulations. The Act on Patients Rights provides the patient with a right to be informed of his medical file, which in effect implies a right to a medical file.
2. The patient has a right to access and transcribe without hindrance medical documentation related to him, but under the condition that this is done in the presence of a doctor or health care worker. The patient also has a right to independent access to his electronic medical file and information contained on his health insurance card, where the system allows this.
3. A patient has the right to nominate persons who have access to his medical documentation and persons who are prohibited access to his medical documentation, provided that this does not contravene any laws.
4. The right to access data from a person's medical files usually belongs only to the person for whom the data applies. But the General Practitioners Services Act determines that in exceptional cases, where the attending physician concludes that this would benefit the patient, the doctor may provide the patient's immediate family or guardian or his cohabiting partner the information without prior approval from the patient.
5. The Act on Patients Rights provides the patient with the right to photocopy, transcribe or otherwise copy his medical documentation.
6. The right to be acquainted with a patient’s health file after his death is held by the patient’s spouse, cohabiting partner, same sex partner, children or adopted children, or, if the patient has no such relatives, by his parents. They are given the right to access only the data that are necessary for the accomplishment of the legal intention of getting acquainted with those data.
7. The Act on Patients Rights sets down a special right held by the patient to request that his remarks are added to his medical file.
