Section 8 of the Constitution states that the private life, honour and home of every person shall be secured and that detailed provisions on the protection of personal data shall be prescribed by Act of Parliament. Patients must be treated in such a way that their human dignity is not violated and that their conviction and privacy are respected.
The provisions concerning confidentiality do not apply if the information is necessary for treatment or care of the patient in another health care unit. Nevertheless, the oral consent of the patient is necessary or consent must be obvious from the context.
Information about the identity and state of health of a person who is unconscious can be given to a close family member, provided that there is no reason to believe that the patient would object had he/ she been able.
