1. In every health care service a commission for the relations between users and health care providers and for the quality of care is established. This commission controls whether the rights of the patient are being respected and the improvement of the quality of the care. This commission sees that patients can express their complaints to the persons responsible for the health care service, that they get an explanation and that they are kept informed of the continuation of their complaint (art. L. 1112-3, second paragraph of the Code of Public Health).
2. In France, there is strict liability in some cases (nosocomial infections) and there is a compensation mechanism for serious treatment accidents, irrespective of fault, under the principle of national solidarity.
