- If the patient is prohibited or incapable to consent, the Code of Medical Ethics stipulates that the consent to diagnostic and therapeutic interventions, and the treatment of sensitive data, should be expressed by the legal representative (article 33).
- The physician must take into account previous statements of the patient when that patient can not express his own will due to a grave danger for his or her life.
- The physician is obliged to inform patients who are mentally ill and to take into account their will, considering their age and capability of comprehension, with respect to the rights of the legal representative (article 34).
