According to the Act on hospital establishments every hospital director has the obligation to foresee in a mechanism through which suggestions, expressions of dissatisfaction and complaints can be treated. Without prejudice to this provision, the leading civil servant of the ministry of public health a research may examine the validity of every complaint of a (hospital) patient. In order to carry out this examination he has access to the medical file of the complainant
If the patient is under 21, incapacitated or deceased, a complaint can be lodged by the legal representative of the patient or a fellow man who has a material or moral importance.
