  1. The Act on hospital establishments contains no provisions concerning the contents of the information that has to be communicated. The explanatory memorandum of the Act clarifies only that the information has to be communicated taking into account the needs of the patient and his comprehension, the seriousness of the disorder and the necessity of the intervention. Only the exceptional risk linked to a treatment must be communicated.
  2. The Code of medical ethics stipulates that the physician must supply honest, clear and information, taken into consideration the intellectual capacity of the patient. This information may concern among others the following elements: the possible examination, the risks linked to diagnostic and therapeutic intervention, the risks in case of non-treatment etc.
