  1. When the patient is under 21 the consent of the person who has the parental authority has to be obtained as much as possible. Depending on his age and his maturity, the minor has to be involved in the medical decisions. The physician must make efforts to inform the parents in order to obtain their valid consent. In case of an emergency and when the parents cannot be reached, the physician gives he the necessary care. If the opinion of the minor patient can be asked, this has to be taken into account as much as possible. The physician has to defend the interests of the minor patient if he thinks that the patient’s health is not well protected by his environment.
  2. The Law on youth protection stipulates that a physician can do everything that is suitable according to the rules of the medical profession, in case of a serious and immediate danger for the life or the health of the minor patient and in case of refusal of those who have custody over him. He must provide a motivated report regarding the medical decisions to the public prosecutor within three days.z
