Sweden has no specific Patient Rights Act. Patient rights are promoted in different ways. In several acts – such as the Health and Medical Personnel Duties Act and the Code on Parents, guardians and children – patient rights are regulated in a rather specific way. The Federation of County Councils has issued a Charter which contains several principles for promoting patient rights based on existing legislation and agreements between the Federation of the County Councils and the State. This document was sent to all the county councils in order to shape in each county a patient rights policy based on the principles of this document. However, this document was not designed to provide legal rights enforceable in court nor can it be considered as a national charter.
In 1997, the official report “The Patient is Right” concluded that patient rights in Sweden are well protected, but the aim should be to propose a patient rights law within the next few years to come. In the mean time, however, a number of complementary provisions were proposed, which came into force in 1999.
